30-Day
Limited Hardware Warranty - (90-Day on Systems)
Operator
Headgap Systems, Inc. gives a limited warranty covering
its hardware products against defects in materials and
workmanship for a period of 30-days (90-Day on Systems)
commencing on the invoice date as shown on the original
dated invoice. The warranty extends only to you, the
original purchaser from Operator Headgap Systems, Inc. It
is not transferable to anyone who subsequently purchases
the product from you. The warranty covers all new and
refurbished merchandise unless otherwise indicated at the
time of purchase and noted on the invoice.
The
warranty on all Operator Headgap Systems, Inc.
merchandise is applicable to only component part failure,
defect or malfunction, and DOES NOT COVER: (1) the
cosmetic condition of new or refurbished merchandise; (2)
damage due to external causes, including accident, abuse,
misuse, problems with electrical power, servicing not
authorized by Operator Headgap Systems, Inc., usage not
in accordance with product instructions, failure to
perform required preventive maintenance, and problems
caused by use of parts or components not supplied by
Operator Headgap Systems, Inc. (3) loss of applications
or data due to failed, defective or malfunctioning
merchandise; (4) the performance of Operator Headgap
Systems, Inc. merchandise with other merchandise
purchased separately; (5) the physical or operating
condition of Third Party products used in conjunction
with equipment purchased from Operator Headgap Systems,
Inc.; and (6) any problems caused by or products used in
conjunction with the purchased merchandise.
This
warranty does not cover any items that are in one or more
of the following categories: software; external devices
(except as specifically noted); accessories or parts
added to Product after the Product is purchased from
Operator Headgap Systems, Inc.; accessories or parts
added to Product that are not installed by Operator
Headgap Systems, Inc. Keyboards and mice are included and
covered under this warranty.
Operator
Headgap Systems, Inc. will only repair or replace
products covered under this limited warranty that are
returned by you to the Operator Headgap Systems, Inc.
facility. To request warranty service, you must call
Operator Headgap Systems, Inc.'s Customer Technical
Support within the warranty period. If warranty service
is required, Operator Headgap Systems, Inc. will issue a
Return Material Authorization (RMA) Number. You must ship
the products back to Operator Headgap Systems, Inc. in
their original or equivalent packaging, prepay shipping
charges, and insure the shipment or accept the risk of
loss or damage during the shipment. You must include a
copy of the original sales invoice. Operator Headgap
Systems, Inc. will ship the repaired or replacement
products to you (freight prepaid) if you use an address
in the continental U.S. where applicable. Shipments to
other locations will be made freight collect.
NOTE:
Before you ship the Product(s) to Operator Headgap
Systems, Inc., back up the data on the hard-disk drive(s)
and any other storage device(s) in the product(s). Remove
any removable media, such as diskettes, CDs, or PC Cards.
Operator Headgap Systems, Inc. does not accept liability
for lost data or software.
Operator
Headgap Systems, Inc. owns all parts removed from
repaired Products. Operator Headgap Systems, Inc. uses
new and reconditioned parts made by various manufacturers
in performing warranty repairs and building replacement
Products. If Operator Headgap Systems, Inc. repairs or
replaces Product, its warranty term is not extended.
If
Operator Headgap Systems, Inc. elects to exchange a
Product or portion of a Product, the exchange will be
made in accordance with Operator Headgap Systems, Inc.'s
Exchange Policy in effect on the date of the exchange.
In the
event of any failure, defect, or malfunction of the
merchandise in breach of the limited warrant, the sole
and exclusive remedy available to the buyer shall be, at
Operator Headgap Systems, Inc.'s sole discretion, either
(1.) a refund of the purchase price paid by the buyer or
(2.) repair or replacement of the defective product or
part.
THE
LIMITED WARRANTY SET FORTH ABOVE IS EXCLUSIVE AND IS IN
LIEU OF ALL OTHER WARRANTIES AND CONDITIONS EXPRESS OR
IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE
AND NON-INFRINGEMENT, STATUTORY OR OTHERWISE WITH RESPECT
TO THE SERVICES OR PRODUCTS PROVIDED UNDER THIS
AGREEMENT. Operator Headgap Systems, Inc.'S
RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN ANY
PRODUCT SOLD IS LIMITED TO REPAIR OR REPLACEMENT AS SET
FORTH IN THIS WARRANTY STATEMENT. SUCH WARRANTY SHALL NOT
BE EXTENDED, ALTERED, OR VARIED EXCEPT BY A WRITTEN
INSTRUMENT EXECUTED BY THE PARTIES.
IN NO
EVENT SHALL Operator Headgap Systems, Inc. BE LIABLE TO
THE BUYER OR OTHERS FOR ANY SPECIAL, COLLATERAL,
INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES,
REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON Operator
Headgap Systems, Inc.'S TORT, INCLUDING NEGLIGENCE,
BREACH OF CONTRACT, STRICT LIABILITY, BREACH OF
WARRANTIES, FAILURE OF ESSENTIAL PURPOSE OR OTHERWISE,
EVEN IF BUYER HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES. THE TOTAL LIABILITY OF Operator Headgap Systems,
Inc. TO THE BUYER, IF ANY, FOR BREACH OF CONTRACT OR
WARRANTY, NEGLIGENCE OR OTHERWISE SHALL IN NO EVENT
EXCEED THE PRICE PAID BY THE BUYER FOR THE MERCHANDISE
SPECIFIED IN THE INVOICE. SOME STATES, JURISDICTIONS, AND
COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LIABILITY, SO THE
PRECEDING LIMITATION OR EXCLUSION MAY NOT APPLY TO THE
BUYER.

Merchandise
Return Procedures
Operator
Headgap Systems strives to provide quality products to
our customers. Occasionally, issues with merchandise will
escape our attention. It is our aim to satisfy our
customers to the best of our ability.
- Systems
carry a 90 day warranty, individual parts or
accessories a 30 day warranty. Any new parts, whether
in a system purchased from us or not, carry the full
manufacturer's warranty. Warranty issues after 30 days
on new merchandise should be pursued with the
manufacturer.
- Operator
Headgap Systems' warranty is repair or replace. In the
event the item(s) cannot be repaired or replaced,
Operator Headgap Systems will issue a credit.
- In
the event you, the purchaser, decide you do not want
an item (exclusive of opened software), the
merchandise may be returned for a credit of the
purchase price less shipping. A 15% restocking fee may
also be imposed. If you order the wrong item and
return it to exchange for the correct item, only the
purchase price (less shipping) of the original item
will be applied toward the replacement item. Opened
software cannot be returned.
- You
must call or email and receive an RMA number before
returning any item for any reason. This RMA number
must be visible on the outside of the package. Item(s)
should be returned within 10 days of issue of RMA.
- Any
merchandise returned to Operator Headgap Systems
should be packaged adequately to prevent damage, and
should be insured if appropriate. All return shipping
costs are the responsibility of the
purchaser.
